What Qualifies as Domestic Violence in New Jersey?

Domestic violence isn’t limited to physical harm. Under the New Jersey Prevention of Domestic Violence Act, abuse can take many forms, including:

  • Physical assault or threats of violence
  • Emotional and psychological abuse
  • Sexual assault
  • Harassment or stalking
  • Criminal trespass or destruction of property
  • Kidnapping or false imprisonment

To qualify for protection under the law, the victim and abuser must have a domestic relationship, such as current or former spouses, people who live together, dating partners, or individuals who share a child.

Temporary Restraining Orders (TRO)

If you’re in immediate danger, you can request a Temporary Restraining Order (TRO) from the court. This can be done through your local police department or family court, often within hours of reporting the incident.

A TRO may:

  • Order the abuser to stay away from you, your home, and your workplace
  • Grant you temporary custody of the children
  • Require the surrender of firearms
  • Prohibit contact of any kind, including through third parties or social media

Final Restraining Orders (FRO)

Within 10 days of a TRO being issued, the court will schedule a hearing to determine whether a Final Restraining Order (FRO) is warranted. Both parties have the right to present evidence, call witnesses, and testify.

If the court finds that domestic violence occurred and that ongoing protection is necessary, it will issue a permanent FRO, which can:

  • Prevent the abuser from contacting or approaching you permanently
  • Grant permanent custody and support orders
  • Have consequences for employment, housing, and immigration
  • Be entered into a statewide registry accessible by law enforcement
